brand new pi5 with ugreen 25173, network fails to start but only when capture card is connected

Hi All,
wondering if anyone else has come across the above issue?
I'm using the official pi power supply, have checked the current draw and its less than 5 watt's.
hyperhrd boots fine and is responsive as long as the capture card isn't connected but if I boot with it connected the networkmanager fails and it doesn't get an IP.
card is plugged into the blue usb3 port (have tried both)
originally tried v21 but have also tried the latest beta.
have tried setting max usb current enable in the config file (just in case)
any advice gratefully accepted
